In 2011, FMCSA – Federal Motor Carrier Safety Administration – passed a rule for truck drivers on limitations and guidelines they need to follow in order to avoid violations – also known as – “Hours of Service.”
Per FMCSA, these are the stated guidelines:
- All drivers have an 11-Hour Driving Limit:
May drive a maximum of 11 hours after 10 consecutive hours off duty.
- Per 14-Hour Limit:
Drivers may not drive beyond the 14th consecutive hour after coming on duty, following 10 consecutive hours off duty. (Off-duty time does not extend the 14-hour period.)
- Rest Breaks:
May drive only if 8 hours or less have passed since end of driver’s last off (duty or sleeper berth period of at least 30 minutes.)
- Sleeper Berth:
Drivers using the sleeper berth provision must take at least 8 consecutive hours in the sleeper berth, plus a separate 2 consecutive hours either in the sleeper berth, off duty, or any combination of the two.

1.) I GOT A VIOLATION, HOW CAN I FIX THIS?
- If you received a driving violation, there is no way to fix this; UNLESS it was a violation within the app.
2.) I CAN USE MY ELD ON ANY TRUCK OR FLEET
- Every device has it’s own MAC ID and Vin number linked to the truck it was set up to. An ELD device is not a “plug and play” type of device that you can simply stick into any truck.
3.) I CAN DELETE MY LOGS OR EDIT MY MILES
- There is no way to edit your miles which is a partial reason for the “ELD Mandate” of December 2017.

According to Transport Topics News, the FMCSA – Federal Motor Carrier Safety Administration – has assigned severity weights as a rating system for ELD violations:

“As of April 1, 2018, violations related to electronic logging device regulations found during roadside inspections are being used in the SMS (Safety Measurement System). These violations are not being applied retroactively; violations recorded prior to April 1, 2018, will not be counted in SMS. Motor carriers that have received ELD-related violations will start to see them reflected in their HOS Compliance BASIC in early May 2018 when the next monthly SMS results are released.” (FMCSA Assigns CSA Severity Weights to ELD Violations)

An ELD – also known as Electronic Logging Device – is an electronic hardware that attaches to the engine of a commercial motor vehicle for the sole purpose of recording driving hours.
Previously, paper logs or automatic onboard recording devices (AOBRD) were used for HOS tracking. Due to the inconsistent data left for enforcement personnel to review created the ELD mandate of December 2017.

In an effort to improve the safety and accuracy for commercial motor vehicles, the FMCSA mandated that all truckers – solo and fleet drivers – be compliant by having an ELD – electronic logging device – attached to every truck heading on the road.
Although, you are not required to use test procedures, FMCSA intends to use specific procedures to confirm compliance of an ELD if validation are needed or desired. The development of a training manual – per service contract – will ensure that all ELDs are tested using the same procedures, as well as a verification process which will ensure sufficient results to evaluate ELDs properly.
